Golf SimIQ — End-User Licence Agreement & Privacy Notice
Effective date: 31st May 2026 Publisher: Purebyte Ltd, a company registered in Republic of Ireland (company no. 564191) ("Purebyte", "we", "us").
This document has two parts:
- Part A — End-User Licence Agreement (EULA): the terms on which you may use the Golf SimIQ desktop application ("SimIQ" or the "Software").
- Part B — Privacy Notice: how SimIQ handles your data, in line with Irish and EU data protection law.
By installing or using SimIQ you agree to Part A and acknowledge Part B. If you do not agree, do not install or use the Software.
Part A — End-User Licence Agreement
1. Licence
Purebyte grants you a personal, non-exclusive, non-transferable, revocable licence to install and use one copy of SimIQ on a Windows PC you own or control, for your own golf-practice and coaching purposes. The Software is licensed, not sold; Purebyte and its licensors retain all rights, title, and interest in the Software.
2. Restrictions
You must not, except to the extent applicable law prevents us from restricting you:
- copy (other than for normal use and backup), sell, rent, sub-licence, or otherwise distribute the Software;
- reverse engineer, decompile, or disassemble the Software, or attempt to derive its source code;
- remove or alter any proprietary notices in the Software; or
- use the Software unlawfully, or in a way that infringes the rights of others.
3. Third-party software and services
SimIQ incorporates third-party open-source and commercial components, and connects to third-party services. The open-source components and their licences are listed in the Third-Party Notices (available in the application under Settings → About, and in the `THIRD-PARTY-NOTICES.txt` file distributed with the Software). Your use of third-party services (for example OpenAI and Skillest) is also governed by those providers' own terms; see Part B for what data is involved.
4. AI Coach — important notice
SimIQ includes an optional "AI Coach" feature that uses a third-party artificial-intelligence service (OpenAI) to generate golf-swing feedback. AI-generated coaching is general information only. It is automated, may be inaccurate or incomplete, and is not professional, medical, physiotherapy, or fitness advice. Do not rely on it as a substitute for a qualified coach or healthcare professional. You are responsible for deciding whether and how to act on it.
5. Health and safety
Golf involves physical activity and a risk of injury. You use SimIQ and act on any feedback it provides at your own risk. Warm up appropriately, use equipment safely, and stop if you feel pain. If you have any doubt about your fitness to play golf, consult a healthcare professional.
6. Updates
SimIQ may check for and install updates automatically to keep the Software secure and functional (see Part B, §4). Updates are provided under this same agreement unless accompanied by separate terms.
7. No warranty
To the maximum extent permitted by law, the Software is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranties of satisfactory quality, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Software will be uninterrupted, error-free, or that swing measurements, trajectories, or AI feedback are accurate.
8. Limitation of liability
Nothing in this agreement limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any liability that cannot be limited or excluded under applicable law.
Subject to the above, and to the maximum extent permitted by law:
- we are not liable for any loss or damage that is not reasonably foreseeable, or for any loss of profits, data, goodwill, or business; and
- because SimIQ is provided to you free of charge, our total aggregate liability arising out of or in connection with the Software is limited to £100.
This Software is intended for consumer, recreational use. If you use it for any business purpose, we have no liability to you for loss of profit, business, or business opportunity.
9. Termination
This licence applies until terminated. It terminates automatically if you breach it. On termination you must stop using and uninstall the Software. Sections that by their nature should survive (including §§ 7, 8, 10) survive termination.
10. Governing law
This agreement and any dispute arising from it are governed by the laws of Ireland, and subject to the non-exclusive jurisdiction of the courts of Ireland. If you are a consumer resident in the European Union, you may also bring proceedings in your home jurisdiction; nothing here affects your statutory rights.
Part B — Privacy Notice
This notice explains how SimIQ handles personal data. Purebyte Ltd is the data controller for the limited data described below. Contact: privacy@purebyte.com.
1. Where your data lives — local by default
SimIQ is a desktop application and most of your data stays on your own computer. We do not operate a central account system, and the following are stored locally on your device and not transmitted to Purebyte:
- Swing videos and clips — saved under your `Videos\SimIQ` folder.
- Shot data and metrics — captured from your launch monitor and stored with each shot.
- Golfer profiles — names, dates of birth, handedness, and handicaps you enter, plus AI coaching-journal notes, stored in a local database (`profiles.db`).
- Face and build data for golfer recognition (optional, off by default). If you turn on *Golfer recognition* (Settings → Camera) and a golfer ticks *"Remember my face and build"* on their own profile, SimIQ analyses the face-on camera feed and that golfer's face-on swing clips on your computer and stores, for that golfer in `profiles.db`, a small number of numerical face templates and body-build measurements taken at address (shoulder width, hip width, torso length and height, as proportions of the camera picture — no images), so it can switch to their session when they step up to the mat and file each shot under the golfer who hit it. These templates and measurements are biometric data: they are created and used only on your device, are never sent to Purebyte or any third party, are not included in cloud sync, phone sync or diagnostic bundles, and are deleted when the golfer unticks the option, clicks *"Forget my face"*, or the profile is deleted. Guests and golfers who have not opted in are never stored. Only enable this for golfers who have agreed to it.
- Settings — including any API keys you enter, stored in `settings.json` in your Windows user profile.
Swing videos may show identifiable individuals and so may be personal data; they remain on your device unless you choose to use a feature that sends them onward (below).
2. Features that send data to third parties
Some optional features transmit data to third-party services. These run only when you choose to use them.
a) AI Coach (OpenAI). When you use the AI Coach, SimIQ extracts a small number of still frames from the relevant swing video and, together with the shot's metrics and your typed questions, sends them to OpenAI's API to generate coaching responses (and, if you enable spoken responses, to generate audio). This uses an OpenAI API key that you supply and which is stored locally on your device. Data sent to the OpenAI API is processed under OpenAI's terms and privacy policy; OpenAI states that API data is not used to train its models by default and is retained for a limited period for abuse monitoring. Purebyte does not receive this data. Do not use the AI Coach with images or information you are not comfortable sending to OpenAI.
b) Skillest upload (optional). If you sign in to Skillest within SimIQ and choose to upload a shot, SimIQ sends the relevant swing video, images, and shot data to Skillest using credentials you provide. This is governed by Skillest's own terms and privacy policy.
c) iOS streaming source (optional). If you use an iPhone as a camera source, video is streamed over your local network between the phone and the PC. It is not sent to Purebyte.
3. Diagnostics and analytics
a) Anonymous diagnostics (on by default, you can turn it off). To keep SimIQ reliable, the Software sends limited diagnostic and usage telemetry to Microsoft Application Insights (hosted by Microsoft in the United Kingdom and EU). This consists of: crash and error reports (the error type, message and program stack trace, and the context in which it occurred, such as "capture" or "cloud sync"); the app version, operating system version and a randomly generated device identifier that is not linked to your name, e-mail or licence key; feature-usage events (for example that a shot was captured, which camera and launch-monitor type were used and how long the capture took, that a session analysis was run, that the AI Coach was used, and how long the app was open); and the counts of profiles and shots. It does not include swing video, shot data, profile names, handicaps, AI Coach conversations, licence keys or your e-mail address. We rely on our legitimate interest in keeping the Software stable and secure for this processing, and you can object at any time by turning it off in Settings → About → "Send anonymous diagnostics"; the Software shows this choice once on first run. When it is off, nothing is sent.
b) Diagnostic log file (off by default). Separately, you can enable a diagnostic log file in Settings → About to help us investigate a problem you report. The log is written only to your computer and is sent to us only if you choose to send it. It records what the Software is doing, and can include: your computer name; your camera and launch-monitor device names and serial numbers; the names of your golfer profiles; your settings (which camera source, launch monitor and features are configured); the folder paths of your session and shot files; launch-monitor measurements for each shot; and the same error details as above. It does not include swing video, your Windows user name, licence keys, API keys or AI Coach conversation content. If you send us a log, we use it solely to diagnose your issue and delete it when the issue is closed.
4. Updates
SimIQ periodically contacts our update feed (hosted on Microsoft Azure) to check for and download new versions. These requests involve standard technical information (such as your IP address and the current version) handled by the hosting provider; we do not use it to build a profile of you.
5. Legal bases (GDPR)
Where we process personal data, we rely on: legitimate interests (keeping the Software secure, stable, and improving it — diagnostics and updates); and performance of this agreement / your consent for optional features you actively choose to use (AI Coach, Skillest). Where we rely on consent, you can withdraw it at any time by not using the feature.
6. International transfers
Some third-party services (notably OpenAI) process data outside the EU/EEA, including in the United States. Where SimIQ sends data to such services at your direction, that transfer is made to provide the feature you requested; the provider is responsible for safeguarding it under its own terms and applicable transfer mechanisms.
7. Retention
Locally stored data (videos, shots, profiles, settings) remains on your device until you delete it. Anonymous diagnostic telemetry is retained in Application Insights for 90 days and then deleted automatically; a diagnostic log file you send us is deleted once your issue is closed. Data sent to third-party services is retained according to those providers' policies.
8. Your rights
Under the EU General Data Protection Regulation (GDPR) and the Irish Data Protection Act 2018 you have rights to access, correct, delete, restrict, or object to our processing of your personal data, and to data portability. Because most data is stored locally, you can exercise many of these rights directly (by editing or deleting profiles, videos, and settings in the app or on disk). For data we control as described above, contact privacy@purebyte.com. You also have the right to lodge a complaint with the Irish Data Protection Commission (DPC) at dataprotection.ie.
9. Children
SimIQ is not directed at children under 13. If you create a profile for a child, you are responsible for that information and for any third-party features you choose to use with it.
10. Changes to this notice
We may update this document from time to time. The current version is available within the application (Settings → About) and at https://www.purebyte.com. Material changes will be reflected by updating the effective date.
